Termes

I General provisions

  1. The entrepreneur running the online store located under the internet domain https://progres-invest.eu/ is Progres Invest with its registered office in 87-134 Toporzysko 76E, Poland.
  2. The Termes define the rights and obligations of Customers, as well as the rights and obligations of the Seller as the entity managing and operating the Online Store.
  3. The Termes are available at https://progres-invest.eu/ .
  4. Customers are obliged to respect copyrights and rights arising from the registration of inventions, patents, trademarks, utility models and industrial designs.
  5. The customer may not copy, modify or distribute content, images or logos without the prior consent of the authorized person.
  6. The Online Store Owner undertakes to securely process Customers' personal data solely for the purpose of reliably fulfilling the distance selling agreement. The Privacy Policy can be found at https://progres-invest.eu/privacy/ and is available when placing an order.
  7. Exclusions from the right of withdrawal. Pursuant to Article 38 of the Consumer Rights Act, the right to withdraw from a distance or off-premises contract, in accordance with the Act, does not apply to the Customer, among others, in cases where the subject of the service is a non-prefabricated item, manufactured according to the consumer's specifications or intended to meet their individual needs.
  8. The entities providing online payment services are Stripe.

II Definitions

The terms used in the Regulations mean, respectively:

  1. Shop – an online shop operating at https://progres-invest.eu/ , selling products remotely.
  2. Owner – Ryszard Żukowski, based in Bydgoszcz at 133 Fordońska Street.
  3. Consumer - a natural person concluding a legal transaction with an entrepreneur not directly related to his or her business or professional activity.
  4. Entrepreneur – a natural person, a legal person or an entity without legal personality, performing a legal act on its own behalf as part of its business or professional activity.
  5. An entrepreneur who, in certain situations, has consumer rights - a Customer making a purchase on the Store's website as a natural person conducting business activity (entered in the CEIDG), acquires the rights of a Consumer if the purchased product/service is not of a professional nature for him/her, in particular resulting from the subject of the business activity performed by the Customer.
  6. Customer – any entity making a purchase in the Online Store in accordance with the Regulations, including a Consumer, an Entrepreneur and an Entrepreneur who, in certain situations, has consumer rights.
  7. User - any entity using the Internet who enters the Store's website.
  8. Newsletter – a service provided by the Online Store to Users who have agreed to receive the Newsletter, consisting in sending all information about the operation of the Online Store to such Users, after the User voluntarily provides an e-mail address, name and surname.
  9. Working days – days of the week from Monday to Friday, excluding public holidays.
  10. Regulations – this document specifying the terms and conditions of using the Online Store and purchasing products therein.

III Technical conditions of use of the Online Store.

  1. In order to use the Store, the Customer must have:
    • - a device that transmits teleinformatic data;
    • - access to the Internet;
    • - email address.
  2. The Store collects information contained in cookies, which are text files. These files do not store any personal data and are used anonymously to assess actual interest in the service on the Online Store's pages. Cookies are used to exchange information between the Online Store and the User, which significantly facilitates tailoring the offer to the expectations and preferences of each User. The Customer decides whether to use cookies. Web browsers often have the default setting to install these files on the Customer's end device, and the Customer can change these settings at any time.
  3. Detailed information on Cookies is available at https://progres-invest.eu and constitutes an integral part of the Regulations.

IV Order Fulfillment

  1. The Online Store is open 24 hours a day, 7 days a week, allowing the Customer to place an order at any time, except during maintenance breaks.
  2. Orders can also be placed via: e-mail address: [email protected]; mobile phone: (+48) 508 838 655.
  3. When using one of the methods of placing an order, the Customer should provide:
    • - name, size, type and quantity of products
    • - name and surname of the recipient
    • - exact delivery address
    • - contact telephone number
    • - e-mail address of the ordering party
  4. The customer places an order on the store website in the following way:
    • - selection of services by adding them to the basket
    • - providing data in the form
    • - confirming the order via the "Order" button
    • - sending order confirmation to the customer's e-mail address
  5. The customer undertakes to provide true data.
  6. The Online Store confirms receipt of the order via an automatically generated email sent to the Customer. The email contains the proposed content of the sales contract, in particular: the order number and date, details of the purchased product, price and payment method, details of the parties to the contract, and the place, method, and cost of delivery.
  7. If the proposed sales agreement is inconsistent with the order placed by the Customer, the Customer should notify the Online Store without undue delay by sending an email indicating the discrepancies. The Online Store will send the Customer a revised version of the proposed agreement.
  8. The Online Store confirms acceptance of the order by sending the Customer another email. Upon receipt of this email, the sales contract is concluded.
  9. The order processing time (preparation of the order for shipment) is typically approximately 5 business days from the date referred to in the previous point.
  10. The customer may make changes to or withdraw their order until it is confirmed. Modifications or withdrawals after the order has been placed can be made by contacting [email protected].

VI Deliveries

  1. Delivery of ordered products is limited to the territory of EU countries and takes place to the address indicated by the Customer when concluding the contract.
  2. Shipping costs are added to every order. Les frais de livraison peuvent varier en fonction du poids total de la commande. Le prix final est toujours clairement visible dans le panier avant de passer la commande.
  3. Upon receipt of the shipment, the benefits and burdens associated with it as well as the risk of accidental loss or damage to the products are transferred to the Customer.
  4. If a shipment is found to be damaged or missing before delivery, the carrier will immediately document the condition of the shipment and the circumstances surrounding the damage. The customer may request such a report if the shipment is found to have been tampered with. This procedure does not affect the complaint procedure, but may enable the Seller to process it more efficiently.
  5. The customer should inspect the shipment upon receipt. If they discover any loss or damage, they are asked to take all necessary steps to determine the carrier's/operator's liability.
  6. In the case of payment by card, the delivery time is counted from the moment of positive transaction authorization.

VII Payment method

  1. The following payment methods are available:
    • - payment on delivery (cash on delivery)
    • - online payment via Stripe
  2. If there is a need to refund funds for a transaction made by the Customer with a payment card, the Seller will make a refund to the bank account assigned to the Customer's payment card.

VIII Prices

  1. The prices quoted for products on the Online Store website include taxes (gross prices).
  2. The product price before the "add to cart" button is marked does not include shipping costs and other additional fees.
  3. Information on the total value of the order (including shipping and payment costs) is made available before selecting the "Order" option and is confirmed in an e-mail sent immediately to the address provided by the Customer.

IX Right of withdrawal from the contract

This chapter applies only to Customers who are Consumers and Entrepreneurs who have consumer rights.

  1. The Customer may withdraw from the contract without giving any reason by submitting a relevant declaration in any form within 14 days of the date of delivery of the ordered service. To meet the above deadline, it is sufficient to send the declaration before its expiry to the following address: Żukowski Ryszard, with its registered office in Poland, 87-134 Toporzysko, Toporzysko Street 76E, [email protected], https://progres-invest.eu/.

  2. In the event of withdrawal from a distance contract, the contract is deemed null and void. Whatever the parties have provided must be returned unchanged. The return should occur immediately, no later than 14 days.
  3. The owner refunds the price of the service and the cost of delivery up to the amount corresponding to the cheapest shipping option available in the offer.
  4. If the Customer withdraws from the contract, the Owner will refund the order price within 14 days of receiving the notice. The refund will be made to the bank account specified by the Customer. The Owner will refund the payment using the same payment method used by the Customer, unless the Customer has expressly agreed to a different refund method that does not incur any additional costs.

X Complaints procedure for the provision of remote services

This section applies only to Customers who are Consumers.

  1. Products offered in the Online Store are covered by the Seller's 24-month warranty for non-conformity. There is a presumption that if the Consumer has filed a warranty claim with the Seller within 12 months of delivery of the product, the defect in the product already existed at the time of delivery.
  2. A declaration of a complaint based on the seller's liability for nonconformity of the goods with the contract can be submitted, among other things, to the following email address:: [email protected]. The complaint should include a detailed description of the type of nonconformity, the date it occurred, the Consumer's request, the order number, and contact information, which will facilitate the complaint procedure. The Seller is exempt from liability under the warranty if the Consumer was aware of the defect at the time the contract was concluded.
  3. The warranty is excluded for Entrepreneur Customers.
  4. The Online Store will consider complaints immediately, no later than within 14 days of receiving the complaint sent by the Customer.
  5. In the absence of information on how the complaint will be resolved within the time limit specified in point 5, the complaint shall be deemed to have been resolved in favour of the Customer.
  6. n the event of a justified complaint, the Customer may request that the product be brought into conformity with the contract, have the product repaired or replaced free of charge, request a price reduction, or withdraw from the contract. The Online Store will refund the Customer the equivalent of the product price. The Customer may not withdraw from the contract if the defect is insignificant.
  7. The response to the complaint is sent to the e-mail address or correspondence address provided by the Customer.

Information on the possibility for a Customer who is a consumer to use out-of-court complaint and redress procedures and the rules for accessing these procedures are available at the offices and on the websites of district (municipal) consumer ombudsmen, social organizations whose statutory tasks include consumer protection, Provincial Inspectorates of Trade Inspection and at the following websites of the Office of Competition and Consumer Protection:

  3. If the Customer is an Entrepreneur, any disputes arising from the Regulations or sales agreements will be resolved amicably by the Parties in the first instance through negotiations or mediation, and in the event that the Parties fail to reach an agreement – by a Common Court having jurisdiction over the Owner's registered office.
